General Terms and Conditions

Airport-taxi-wien.com provides services based on the following GTC, service descriptions and price lists. Deviating terms and conditions do not apply even if airport-taxi-wien.com does not expressly object to them. Deviations from these conditions require the express written acknowledgement of airport-taxi-wien.com. A contract is only concluded when confirmed by airport-taxi-wien.com.

Scope of Services

The scope of services is determined exclusively by the written or telephone order confirmation from airport-taxi-wien.com. Information contained in price lists and similar documents is only binding insofar as express reference is made to them. Transport is carried out in accordance with the Road Traffic Act (StVO) and the Passenger Transport Act (PbefG). Passengers must follow instructions from airport-taxi-wien.com and its chauffeurs. If passengers act against instructions or pose a danger under the StVO or road safety through impairment of the chauffeur, Airport-taxi-wien.com is entitled to exclude them from transport. In this case airport-taxi-wien.com charges the full fare including the fixed price or kilometre price and all ancillary and special services.

Airport Transfer

Any change to the agreed pick-up time, for whatever reason, must be communicated to airport-taxi-wien.com immediately. Damage caused by failure to communicate promptly is borne by the customer. The Airport-taxi-wien.com chauffeur is available at the agreed pick-up time at the respective meeting point of the pick-up terminal at the airport, or at the meeting point previously agreed in writing or verbally, with a name sign or company logo (earlier or later availability must be stated when booking) and waits up to 15 minutes without additional charge. A telephone number at which the passenger can reach their chauffeur is stated in the confirmation letter. If after the 15-minute waiting period no contact with the passenger or customer has been established, the chauffeur starts the return journey without the passenger. The service of Airport-taxi-wien.com is then deemed fulfilled and the full fare becomes due. Further waiting times requested by the customer are charged according to the valid price list.

Prices

Prices include statutory VAT at the applicable rate. The prices valid on the day of booking confirmation apply. Flat rates not listed in the price list may be agreed in writing or verbally and apply only for the agreed travel date and respective rental period. Times and distances beyond this are charged according to the valid price list. Additional costs due to delays are borne by the customer unless the delays are caused by airport-taxi-wien.com. The fare includes passenger transport with normal luggage. Transport of bulky goods requires a separate agreement.

Payment Terms

As agreed with airport-taxi-wien.com, outstanding amounts are payable by the passenger or customer either immediately in cash, by credit card to the chauffeur, or by invoice issued by airport-taxi-wien.com. Credit card payments incur an additional fee of 10% of the fare. Timeliness of payment depends on receipt of the amount for unconditional use by airport-taxi-wien.com. For credit card payments the claim is only deemed paid after final complete credit. Payments are always applied to the oldest outstanding claim. If the customer is in default of payment, airport-taxi-wien.com charges interest of 5 percentage points above the base rate — subject to claims for further default damage. A reminder fee of €10 is charged for the second and each subsequent reminder. The customer may prove that a lower damage occurred.

Cancellations and Withdrawal

Cancellations are only effective when submitted in writing or by telephone to Airport-taxi-wien.com. For written cancellations, receipt at airport-taxi-wien.com determines timeliness. Cancellations up to and including 24 hours before the contractually agreed start of the ride are free of charge. For cancellations airport-taxi-wien.com charges a portion of the base fare as compensation. This portion is:

• 30% for cancellations up to 12 hours before
• 80% for cancellations up to 3 hours before the contractually agreed start of service
• 100% for later cancellations and no-shows.

Expenses are charged by airport-taxi-wien.com independently of the timeliness of cancellations if they have already been incurred. The customer is expressly permitted to prove that Airport-taxi-wien.com incurred no or a lower damage. airport-taxi-wien.com reserves the right to withdraw from the contract wholly or partly if the customer stops payment, becomes insolvent, or due to external circumstances it must be assumed that services will be misused, or the customer violates obligations under these contract terms.

Customer Obligations and Liability

The customer must immediately notify airport-taxi-wien.com of any change to their name, (billing) address, legal form and bank details. The customer is also obliged to provide the necessary information about passengers, time and place of service. If the customer fails to notify promptly, they are liable for damage that would have been avoided with timely notification. The customer undertakes, also on behalf of passengers, not to misuse the service of airport-taxi-wien.com, in particular:

• not to disturb or hinder performance of the service
• not to cause damage
• not to violate criminal law provisions
• to strictly observe the no-smoking rule in the vehicle
• not to refuse payment of the fare

Liability of airport-taxi-wien.com

Airport-taxi-wien.com is liable to the customer for damages — regardless of legal grounds — only in cases of intent or gross negligence and culpable breach of essential contractual obligations by airport-taxi-wien.com, its legal representatives or vicarious agents. Liability for injury to life, body or health is governed by statutory provisions. For property damage, liability of airport-taxi-wien.com is limited to €500 per passenger. Vehicles have liability insurance under the applicable general insurance conditions. The customer must arrange any additional insurance themselves. airport-taxi-wien.com is not liable for missed appointments and their economic consequences unless caused by airport-taxi-wien.com. This includes e.g. delays caused by:

• traffic jams, road closures
• vehicle breakdowns or accidents
• bad weather

Airport-taxi-wien.com accepts no liability towards the customer or passenger for damage resulting from incorrect data transmission by the customer.

Applicable Law and Jurisdiction

Austrian law applies exclusively to all legal relationships between airport-taxi-wien.com and its customer. Place of jurisdiction and performance is Vienna.

Partial Invalidity

Should one or more of the above conditions be invalid, the remaining conditions remain unaffected. Invalid clauses are replaced by statutory provisions.
